    MPF exemption

    Hi

    My employer tells me im exempt from MPF contributions for the first year of my employment however I cant find anywhere on the MPF website to back this up.

    A few google searces has turned up quotes from the site on other forums, such as the one below.

    Can anyone confirm?

    Permission Does Not Exceed 13 Months
    8. A person who has been granted an employment visa for permission
    to work in Hong Kong for a period of 13 months or less would be exempt from
    the provisions of the Ordinance. No exemption would be given to a person if
    the permission granted to him is for a period of more than 13 months. The
    length of the employment contract for the person to work in Hong Kong or the
    actual number of days the person has worked in Hong Kong is irrelevant.
    Renewal of Employment Visa
    9. If the original period of a person’s employment visa for permission
    to work in Hong Kong is not more than 13 months, but the visa is renewed and
    brings the person’s total continuous period of permission for employment in
    Hong Kong to over 13 months, that person would cease to be exempt from the
    provisions of the Ordinance from the first day after the 13-month period.
    Whether the renewal of employment visa of the person relates to a different
    employment or relates to the extension of the first employment is also
    irrelevant.

    You only have to pay mpf if you're in a job for more than a yr so if your initial contract is one year, regardless of whether you intend to extend it, you've got a kind of mpf loophole. That's my understanding.

    It works in the company's favour rather than yours... you might take home more without paying your half of the mpf, but you lose out on their mpf payment too.

    I don't know what would happen if you tell your company you want to pay mpf.. this would mean they have to add $1k to your monthly salary before mpf, and they are trying to avoid doing so!

    How much should my employer be contributing after the 13 months? Is it just 1,000 or is it 5% of my salary?

    Nvm found the info.

    Seems its going up to 1,250 from June.

    it's 5% of your salary up to a maximum of $1000

    5% of your income , [max cap 1000 now...and 1250 from Jun-2012].

    its really very much dependent on the employer..
    my old job the employer chose to let me contribute mpf from day 1.. my new employer (after a break out of hk) chose not to..

    in terms of 1k cap, my current employer chose not to cap their contribution for me (i.e. full 5%) whereas i can choose to cap mine at 1k.
