from DH to PA

    Smile from DH to PA

    I've been working for this expat employer for almost 5yrs.She runs her own business and she's already a H.K Permanent Resident. I've been traveling with her most of the time and during this course of my employment she offered me of changing my job status to be her Personal Assistant and of course that goes like helping her all out extra office job etc.as a normal domestic helper we are not allowed to do such things .She has a great trust in me that I can do more than being a domestic helper. I may not be a degree holder but I don't think being a Personal assistant needs to be a degree holder.I'm a computer literate and very much fluent in English and simple cantonese. My sister works for her too as domestic helper also. She's very much willing to do anything or everything to make this happen and as she travels a lot she needs someone else to keep up/or assist with her.
    Is there anyone could give me some advise and tips on this matter? I greatly appreciate it.

    Would be a tricky visa application .. given that you effectively have to prove to immigration why someone locally cannot fill that job.

    that's true..I AM EXPECTING that kind feedbacki!! she did had one but she quit! she can't cope up with my boss.. for the last 5yrs I've been working for her.. she did hired few locals but didn't last long.They can't meet her high standard.
    And as of now, I am very much privelege travelling with her to NZ and USA. Taking charge of all the things for her while she's out of H.K.finally meet her standard.
    She would like me to have the privelege of being a part of her company. She's got 29 H.k staff and 24 in SZ..she runs her own business for the last 28 years here in H.K.. I get paid more that any other D.H., get's yearly bonus of $30thou..
    and she have the confidnence that I can be more than DH.
    we maybe only D.H. the easiest way to get a job overseases, but I am proud to say that inspite of this job where in right now? we are still smart people(ok maybe not all)
    and we do give also our contribution to H.K don't we? we get cut off levy every month.. ( they said for the locals to get trained)?? isn't that sad in our part and yet we get descriminated most of the time..

    Nothing to do with discrimination or nationality.

    The simple fact that the employer has to prove to the immd that you're not displacing a local is pretty much a universal requirement *anywhere* in the world.

    A part of the process involves showing that

    1) Your employer has a unique requirement. I don't think immd would take too kindly to "she does not get along with locals" as requirement.
    2) You're uniquely qualified to meet that requirement...

    Irrespective where you're from, they (your employer) would have to prove why you're so much more uniquely qualified than local residents, indians, filipinos, indonesians included who do not require any sponsorship.

    With the added complication that in making the application your employer can't refer to the fact that you have in effect been doing this job already, because that would be a breach of your visa terms as a DH...

    One solution would, of course, be to marry a HK PR...

    Or continue this way and ask her to offer PA title and salary.. ;-)
    Being smart, i hope, you understand that there is no other legitimate way around except the one PDLM mentioned..
